I hereby irrevocably grant to the American Cancer Society, Inc. and its affiliates (collectively, the
“Parties”) a non-exclusive, perpetual, royalty-free license to the photograph(s) I am submitting
(the “Content”) and the absolute right and permission to use, re-use, modify, publish, and
republish, and to license the right to use, re-use, modify, publish and republish the Content without
any compensation to me or any other party.

I represent and warrant to the Parties that the use of the Content does not violate any law or
infringe or violate the privacy rights, publicity rights, contract rights, copyright rights, and/or other
intellectual property rights of any person or entity.

I represent and warrant to the Parties that I own all rights to the Content and that I have the
exclusive authority to grant the rights set forth in this Consent & Release to the Parties.

I agree to defend, indemnify, release and hold the Parties, their officers, directors, members,
managers, shareholders, subsidiaries, and affiliates, harmless, from and against any claims for:
(a) libel or invasion of privacy; (b) blurring distortion, alternation, and/or optical illusion pertaining
to the Content; (c) breaches by me of this Consent & Release; and (d) any other claims, damages,
costs, and/or expenses, including all costs of legal proceedings and attorney’s fees, arising in
connection with the use off the Content, my granting of the rights set forth in this Consent &
Release to the Parties, and/or any party’s (including the Parties) use of the Content.
