I have a legal type question. Would it be permissable to sell, let's say a home made cookie for $10.00, and give away a cd that you downloaded off of Lime Wire? You wouldn't be selling the cd, right? There are such awesome songs listed on this site, that I thought, making up cd's for a fundraiser would be awesome. I just don't want to break any laws. My brother, who was in the entertainment business for a long time, said he thought that if RFL or ACS has an agreeent with ASCAP, this might be permissable under that agreement. Hi Teri, You touch on a very oogy area. I may be assuming incorrectly, but since LimeWire is a file sharing website, did you pay for the songs you downloaded?
While I can't answer the question about any agreements ACS might have with ASCAP, RIAA has been suing people for illegally downloading music and for illegally sharing music. So I would start with the how the music is obtained and then go from there. But I would be concerned about receiving donations for music that you don't own the copyright to and is not royalty-free.
You don't pay for each song that you download but you do pay a membership fee. It's probably just a good idea that can't come to fruition because of the legal technicalities. Darn it! Thanks for your help. Here's to a successful Relay 2008! Teri
